Welcome to KIDIVIDI
These Terms and Conditions ("Terms") govern access to and use of the KIDIVIDI mobile application and related services (the "App"), operated by JOKOVA ("KIDIVIDI", "we", "us", or "our"). By creating an account or otherwise using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account, adding a child profile, or otherwise using any part of the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you may not use the App.
1.1 Changes to Terms
We may modify these Terms from time to time. We will notify you of material changes by posting an in-app notice or emailing the address on your account at least 15 days before the changes take effect. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
2. Eligibility
2.1 Parents and Guardians
You must be at least 18 years old to create a KIDIVIDI account. By registering, you represent that you are the parent or legal guardian of any child for whom you create a profile, and that you have the authority to agree to these Terms and our Privacy Policy on that child's behalf.
2.2 Children
KIDIVIDI is designed for children to use under active parental setup and supervision. Children do not register their own accounts, do not log in independently, and do not agree to these Terms directly. A child may only access content through a profile created and managed by their parent.
3. Account Registration
To use the App, you must register an account by providing accurate information, which may include your name, email address or phone number, and a password. You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account.
- Keeping your account information accurate and up to date.
- Notifying us promptly of any unauthorized access to your account.
4. Child Profiles
Within your account, you may create one or more child profiles. For each profile, you provide minimal information — such as a Name/Nickname and an age or age range — used solely to personalize content curation and generate the reports described in Section 6. We do not require, and do not collect, a child's full legal name, exact birthdate, school, address, or any government identifier.
You are solely responsible for the accuracy of the information you provide for a child profile and for reviewing and approving all content made available to that profile.
5. How KIDIVIDI Works
KIDIVIDI provides a curated video experience built entirely around parental approval:
- Parents browse and select videos, currently sourced from YouTube, to approve for a child's feed.
- A child can only watch videos that have been explicitly approved by their parent within the App.
- Parents can set a daily screen time limit per child profile; playback is paused or blocked once the limit is reached.
- We may, in the future, add content from sources beyond YouTube; if we do, this section and the Privacy Policy will be updated accordingly.
6. Comprehension Questions and Attention Reports
Certain educational or knowledge-based videos may include short, optional multiple-choice comprehension questions tied to specific moments in the video.
- No score, rank, or grade: KIDIVIDI does not generate or display any numeric "smartness" or intelligence score for a child.
- Purpose: responses are used only to generate a plain-language, descriptive report for the parent.
- Optional: this feature can be turned off at any time in account settings, and any related data can be deleted on request.
7. Acceptable Use
You agree to use the App only for lawful, personal, non-commercial purposes. You agree not to:
- Use the App in violation of any applicable law or regulation.
- Attempt to gain unauthorized access to any part of the App, its systems, or other users' accounts.
- Reverse engineer, decompile, or disassemble any part of the App.
- Use automated means (bots, scrapers) to access or extract data from the App.
- Interfere with or disrupt the integrity, security, or performance of the App.
- Share your account credentials with anyone, or allow a child to access the App outside of the profile and controls you have configured for them.
- Resell, sublicense, or redistribute the App or its content without our written permission.
Violation of this section may result in suspension or termination of your account without notice.
8. Content and Intellectual Property
8.1 Our Content
The App itself — including its design, interface, branding, logo, mascot, features, and underlying software — is owned by or licensed to JOKOVA and is protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from KIDIVIDI's own content or branding without our prior written consent.
8.2 Third-Party Video Content
Videos made available for approval within the App are sourced from third-party platforms, currently YouTube, and remain the property of their respective owners. KIDIVIDI does not create, produce, upload, host, or control this content.
8.3 License to Use the App
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial, family use.
9. Third-Party Content and Platform Disclaimer
KIDIVIDI is a curation and parental-control tool. It is not a content creator, publisher, or host, and does not control the third-party platforms it draws content from.
9.1 Content Provider Responsibility
All video content accessible through KIDIVIDI is provided by third-party platforms, primarily YouTube/Google. KIDIVIDI does not create, edit, moderate, or guarantee the accuracy, legality, or appropriateness of that content. The third-party platform bears sole responsibility for the content it hosts.
9.2 Best-Efforts Curation — No Guarantee
You acknowledge and agree that:
- KIDIVIDI's approval workflow and content classification operate on a best-efforts basis and cannot guarantee complete accuracy.
- Video metadata, categorization, and any AI-assisted classification may occasionally be incomplete or inaccurate.
- Third-party platforms may change their content, APIs, or policies at any time, which may affect KIDIVIDI's functionality.
- Parents remain responsible for reviewing content before approving it for a child's profile.
9.3 Advertising on Third-Party Content
KIDIVIDI does not currently run its own advertising. Any advertisements shown during video playback are served directly by YouTube as part of its standard video experience, and are governed entirely by YouTube/Google's own terms and policies.
9.4 Limitation of Liability for Third-Party Content
To the maximum extent permitted by law, JOKOVA disclaims liability for any content accessed through third-party platforms, including content that may bypass KIDIVIDI's approval or classification systems. Claims relating to the accuracy, legality, or appropriateness of specific video content should be directed to the content provider (e.g., YouTube/Google), not to KIDIVIDI.
10. Parental Responsibility
KIDIVIDI is a tool to assist parental supervision — it does not replace it. By using the App, you acknowledge that:
- You remain responsible for reviewing and approving content before it becomes available to your child.
- You remain responsible for supervising your child's overall use of connected devices.
- KIDIVIDI cannot guarantee that every approved video will remain appropriate if its content is later edited, replaced, or taken down by the original uploader.
11. Technical Dependencies
KIDIVIDI's functionality depends on the continued availability of third-party platform APIs, primarily YouTube's. Changes made by YouTube or other third-party platforms to their infrastructure, policies, or APIs are outside our control and may affect the App's availability or accuracy. We will work to restore functionality promptly following any such disruption, and encourage you to report issues to info@jokova.com.
12. Subscriptions and Payments
KIDIVIDI is currently free to use, and the only advertisements shown are YouTube's own ads during video playback, as described in Section 9.3. We do not currently charge for subscriptions or in-app purchases. If we introduce paid plans or KIDIVIDI-operated advertising in the future, we will update these Terms and our Privacy Policy in advance and clearly disclose pricing, billing terms, and cancellation rights at that time.
13. Termination
We may suspend or terminate your account, at our discretion, for conduct that violates these Terms or that we reasonably believe is harmful to other users, children, or the App itself. You may terminate your account at any time by deleting it within the App or by contacting us at info@jokova.com; upon deletion, your data will be handled as described in our Privacy Policy.
14. Disclaimer of Warranties
The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components, or that content classification and filtering will be 100% accurate.
15. Limitation of Liability
To the fullest extent permitted by applicable law, JOKOVA shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to content accessed through third-party platforms, service interruptions, or reliance on any classification, report, or recommendation generated within the App.
16. Indemnification
You agree to indemnify and hold harmless JOKOVA, its officers, employees, and affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your failure to adequately supervise your child's use of the App.
17. Governing Law and Jurisdiction
These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Ahmedabad, Gujarat, India.
18. General Terms
- Entire Agreement: these Terms, together with our Privacy Policy, constitute the entire agreement between you and JOKOVA regarding the App.
- Severability: if any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
- Waiver: our failure to enforce any right or provision does not constitute a waiver of that right.
- Assignment: you may not assign these Terms or your account without our written consent; we may assign these Terms to a successor or affiliate.
- Force Majeure: we are not liable for failure to perform obligations due to events beyond our reasonable control.
